RESERVATIONS

The number of apartments, prices, checking in, cleaning and other services to be provided by Frogner House Apartments, hereafter FHA, shall be shown on the confirmation of order.

Whilst FHA attempts to satisfy all special requests, FHA does not guarantee that such requests can be accommodated.

Residents must be over the age of 18 (25 for renting during weekends and holidays).Upon arrival,FHA will request a photo identification and authorization from credit card.

Your reservation is not guaranteed before we have cc details or confirmation from the company or travel agency. We do not accept cash.

VALIDITY OF AGREED RATE

The agreed rates are binding on both parties. However, FHA reserves the right to adjust prices in the event of changes due to increased taxes and duties or other circumstances that are beyond the control of FHA. FHA will document these cases carefully and communicate the changes to the customer minimum 1 month before they are implemented.

For cancellations of more than 20% of the number of nights booked, which means that the original discount period is not maintained, FHA reserves the right to adjust the daily prices for the entire period of accommodation.

PRE-AUTHORISATION

Under certain circumstances FHA will require a pre-authorization of a credit card. The pre-authorization is used to cover incidental items including (but not limited to) breaches of terms and conditions, breakages, damages to the apartment or cleaning above the normal level due to the apartment being left in an unacceptable state of cleanliness. The deposit will be released at time of check-out, when the apartment has been checked and is in good condition. Please be advised that the time it takes to release the deposit depends on the guest's bank.

PAYMENT

Payment is required latest at time of check-in. Payment can be made by credit card or prepayment by bank transfer. In case of long-term rental, agreement of monthly payment can be arranged. Always in advance. The customer is responsible for all unsettled bills. All extra services are to be paid when ordered.We accept the following card types; Visa/Mastercard/American Express/JCB/CUP

When the bill is to be settled by invoice, FHA will do a credit check of the company before arrival.Invoice transaction fees applies.

CANCELLATION OF OVERNIGHT ACCOMMODATION AND OTHER GOODS AND SERVICES

All cancellations and amendments related to booking shall be notified to FHA in writing in order to be valid.Other terms may apply if reservation has been made via FHA’s website or third party sites.

Cancellations and amendments of short-term rental (1-7 nights)

Any cancellations/ amendments made later than 16:00 on the day of arrival will be charged in their entirety for up to three days from the day of cancellation.

Failure to turn up without notification(no-show)will be charged 100%

Cancellations and amendments of long-term rental (7 -90 nights)

Any cancellations/ amendments made later than 7 days prior to the day of arrival will be charged in their entirety for up to seven days from the day of cancellation.

Failure to turn up without notification(no-show)will be charged for up to 7 days.

Cancellations and amendments of extended stays(90 + nights)

Any cancellations / amendments made later than 14 days prior to the day of arrival will be charged in their entirety for up to 14 days from the day of cancellation.

Failure to turn up without notification (no-show) will be charged for up to 14 days.

Companies with agreements might be subject to a different cancellation and amendment policy.

  • Check-in is at 15:00 and early check-in requests cannot be guaranteed.
  • Check-out is at 11:00. Late check-outs have to be agreed with FHA prior to check-out time. FHA reserves the right to remove a guest's belongings from the apartment if the guest has failed to check out by 11:00 on the agreed date of departure, and FHA accepts no liability for any loss of or damage to these items whatsoever. FHA will charge one night extra accommodation.
  • Sub-letting of apartment is prohibited. The apartment is only to be used for the purpose of agreed accommodation.
  • FHA do not allow parties in the apartment and are allowed to remove guests that to not follow the instructions.
  • FHA reserves the right to terminate the tenancy of any tenant that creates nuisance.
  • FHA reserves the right to enter into apartments if there is need for it during the tenancy. Natural situations will be: agreed cleaning, reported faults / maintenance, suspicion of water leakage, fire or other damages / maintenance. Every month an unannounced inspection round will be conducted by the Housekeeping Department

LIABILITY FOR DAMAGE

The guest shall be responsible for any damage caused to FHA as a result of negligent or willful behavior on the part of the tenant. Any damage or defects caused during occupancy or when checking out will be repaired by FHA at the customer’s expense. The customer will be charged for the time spent on such repairs or for replacements.

All of our apartments are smoke-free, and non-compliance with such will be subject to a fine of NOK 5000.

It is not allowed to keep pets in the apartments, unless other has been agreed in writing and non-compliance with such will be subject to a fine.

Check-out cleaning for stays under 90 nights is included. When checking out the apartments shall be left in a condition as good as it was when checking in. Negligent use resulting in a need for extra cleaning will be charged to the customer. Stays longer than 90 nights requires an extra cost for check-out cleaning. See separate price list.

FHA accepts no responsibility for loss or damage to guest’s property. FHA encourages all guests to carry travel/ home contents insurance in the unlikely events of such incidents.

The guest shall be responsible for preventing fire, both when using the kitchen and by ensuring that the panel heaters are not covered. Any negligence resulting in fire or an emergency call-out by the Fire and Rescue Service will be charged in accordance with the cost of any such call-outs. The residents are obligated to read the FHA fire instructions, which are placed in every apartment.

COMPLAINTS

Any complaints made by guests or the person making the booking shall be submitted to FHA in writing as soon as possible and no later than the day of departure.

OVERBOOKING

In the unlikely event of overbooking, FHA's hall undertake to provide similar services within the organisation or another company within reasonable proximity of the apartments.

COURT OF VENUE

Any disputes that might arise between the parties to this agreement or on a different basis, or between guests and FHA, shall be dealt with by the Norwegian courts.

FHA offers free Wi-Fi to all our guests. The service is delivered for free, and complains do not give right for compensation.

FORCE MAJEURE

Any events occurring outside the control of the contractual parties -e.g. strikes, lockouts, fire, etc. which make it impossible to comply with the obligations contained in this agreement -gives the right to terminate the agreement without liability.

COOKIES (INFORMATION SHAPER)

Cookies are small pieces of data stored on your computer or mobile phone by the browser you are using. This is done to get information about the type of browser, operating system, whether user orders or not. We use cookies to provide a better and faster service. You can change the settings on your browser to prevent cookies, but you may find that not all features on the site will work. Privacy policy

This is a privacy policy for Merkantilbygg AS' and Frogner House Apartment AS' ("the Lessor") processing of personal data related its guests and tenants. The Lessor will collect personal data about its guests and tenants in order to provide its services. This privacy policy provides information you are entitled to when your personal data is collected, including how the Lessor collects and processes personal data. The privacy policy covers all personal data provided by you, or collected by us as a part of our services. The Lessor is subject to Norwegian law, and will process your personal data in accordance with applicable personal data regulations.

1. Data controller for your personal data

The data controller decides the purposes for and the means by which personal data is processed. For the purpose of this privacy policy, the Lessor is data controller for the personal data provided by you by registering as a member on the Lessor's website; www.frognerhouse.no "the Website" or through renting accommodation or leasing premises.

2. The information the Lessor collects from you

When you register as a customer or lessee of the Lessor, or as a member on the Website, the Lessor will collect and process certain information about you. The type of information the Lessor collects can be sorted into the following categories:

i. Personal information; i.e. information that can be used to identify an individual person, including name and surname, age, sex, date of birth, title/position, credit card information or other financial information, home address or other address, email address, phone number and other contact information, log of activity on user profile and advertising.

ii. Information collected through your use of the Website; i.e. information collected through data tracking, for example by use of cookies (see section 3 below) and by use of analytical tools such as Google Analytics. Information that is collected may include the type of browser you use, which third party website that connected you to the Website, the search words you type in on the Website, the specific sites you visit on the Website and the duration of the visit.

iii. Your IP address and other information about your computer; the Lessor may collect and store your IP address (the number that identifies your computer on the internet) and other information about your computer for system administration purposes (e.g. to calculate how many users that has accessed and used the Website). The IP address will only be stored for the duration of the visit on the Website and will thereafter be either deleted or anonymized.

3. Cookies

the Lessor may use cookies and other information gathering methods to enhance the user experience and optimize the Website. As a visitor on our Website, you will as a main rule remain anonymous. Note however that you will be authenticated. Further, location data is stored for the purpose of optimizing the portal experience. The location data is never linked to the user data.

In order to detect and delete cookies, you can change the settings in your browser. The "Help" function of your browser can help you configure your browser to prevent cookies or delete existing cookies. You can also learn how to block all new cookies on your browser and which configuration steps are required to receive a notification about new cookies. However, please note that if you choose not to accept cookies, your access to certain functionality on the Website may be restricted.

4. Where is your personal data collected?

Personal data is collected through your use of the Website, from the form you complete when you register as a member on the Website, or from the information you provide to the Lessor in connection with your tenancy or lease.

5. How the Lessor use your personal data

The Lessor will use the personal data you provide to us or that the Lessor collects through your use of the Website for the following purposes:

i. to fulfill an agreement with you, i.e. to offer you accommodation or lease of premises;

ii. to enable you to book accommodation or submit a lease application directly from the Website;

iii. to improve our services, the content of the Website and other relevant platforms, for example by collecting and processing data for internal statistical purposes, administration and marketing of the Lessor. This includes identifying general utility models to enable the Lessor to improve its services and the Website;

iv. to respond to your questions and inquiries;

v. to provide you with information of new and other services offered by the Lessor;

vi. to inform you about amendments of this privacy policy;

vii. for examinations of and protection against breaches of this privacy policy, criminal offences, fraud and potential threats against our or other persons legal rights;

viii. to comply with applicable laws and regulations;

ix. for any other purpose either described in this privacy policy, or for which the Lessor will notify you specifically at the time of collection or upon obtaining your consent, or as permitted or required by law, rule, regulation or any other legal process.

6. Consent and other legal basis' for processing of personal data

In order to process your personal data, the Lessor requires your consent or other legal basis. Consent can be given upon request from the Lessor, or by voluntarily giving the Lessor the information through a lease application, the Website or other relevant platforms for the Lessor.

You can withdraw your consent at any time by sending an email to the Lessor, or by deleting your profile on the Website (see section 10). Note that certain services provided through the Website, such as booking accommodation or leasing premises, is dependent on the processing of certain information regarding the customer, and that a withdrawal of consent may involve that the user will not be able to undertake such bookings or leasing through the Website.

Other legal basis for processing can be such processing of personal data that is necessary for the Lessor to comply with all applicable rules and regulations to which the Lessor is subject, e.g. statutory rules related to storage for accounting purposes.

Your personal data will not be stored for a longer period than necessary for the Lessor to fulfill the above mentioned purposes.

7. Disclosure to third parties

The Lessor may disclose your personal data to suppliers and sub-suppliers who perform services for the Lessor, to enable the Lessor to provide you with services. (the Lessor may for example make use of suppliers for hosting of the Website, to facilitate contact with customers via email or SMS, payments systems etc.) Suppliers and sub-suppliers may only use your personal data for the purposes the data was collected for, and to perform its assignments. Any such disclosing of personal data to suppliers and sub-suppliers will be governed by, and done in accordance with, a data processor agreement.

the Lessor will not transfer, sell, rent or exchange personally identifiable information with any third party in a way that is not provided for in this privacy policy without your express consent, unless such obligation is imposed by law or binding court order, or when necessary in a business transaction.

8. Protection of your data

The Lessor takes the privacy rights of our users seriously and have taken reasonable steps to protect the user's privacy, including physical, technical and organisational measures, to prevent loss, alterations, theft and unauthorized access to information stored and otherwise processed by the Lessor.

9. Links to third party websites

The Website may include links to other third party sites. These third party sites have their own privacy policies that determines how the third party site is operated and how personal data is collected and processed. If you submit personal information to any of these third party sites, your information is governed by their privacy policies. the Lessor takes no responsibility for such third party sites, how they are operated and how they process your personal data. The Lessor recommends that you familiarize yourself with such third party sites' privacy policies and terms of use when visiting and using such sites.

10. Your rights

You have the right to require access to the personal data the Lessor has collected about you. If you have registered a member profile on the Website, you can easily log into your profile on the Website and correct errors in the personal data that is stored there, or delete your member profile.

You have the right to demand your personal data deleted at any time. Upon such an inquiry, all your personal data will be deleted, unless statutory obligations or legitimate interests require continued storage. Anonymized information, i.e. information that cannot be linked to you, may be subject to continued storage.

If you want to exercise your right to:

i. get information about what personal data the Lessor has registered on you;

ii. change or update the stored data and correct any errors in that data;

iii. request that unnecessary data is erased;

iv. stop receiving emails from us, such as newsletters and similar;

v. withdraw your consent to the collection, processing, use or disclosure of your personal data to third parties;

vi. request information about your right to data portability, i.e. your right to obtain, reuse and transfer personal data provided to the Lessor to another IT environment;

you should contact the Lessor via the contact information stipulated above in section 1.

If you believe that our processing of your personal data infringes relevant data protection regulations, you are entitled to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of the alleged infringement, or other relevant supervisory authority. In Norway, this is Datatilsynet.

11. Modifications to the privacy policy

the Lessor reserves the right to modify this privacy policy from time to time. The most recent revision shall supersede any earlier versions. The current version of the privacy policy will be available at the Website at all times. The Lessor will notify the user of any changes to the privacy policy that will require your consent.

By using the Lessor's services, you accept electronic information about and publication of this privacy policy on the Website, and you consent to that electronic information about and publication of revised versions of this privacy policy on the Website is valid as a notification to you.
